These Terms of Use (“Terms”) govern your access to and use of the Bayanat eSIM mobile application (“App”), website located at www.bayanat.app (“Website”), and related services (collectively, the “Services”) provided by Wavai Technology LLC (“Company,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

Mobile data plans with various data amounts, validity periods, and coverage areas
Regional and country-specific data plans
Unlimited data plans (where available)

4. Eligibility and Account Registration

4.1 Age Requirement

You must be at least 18 years old to use our Services. By using Bayanat eSIM, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4.2 Account Registration

To access certain features of our Services, you may be required to create an account. When creating an account, you agree to:

Accept responsibility for all activities that occur under your account

4.3 Account Termination

5. Device Compatibility

5.1 Device Requirements

Our eSIM services require a compatible device. You are responsible for ensuring your device:

Supports eSIM technology
Is unlocked (not carrier-locked)
Meets the technical requirements for eSIM installation
Is compatible with the network operators in your destination country

5.2 Compatibility Disclaimer

Wavai Technology LLC is not responsible for device incompatibility issues. We do not guarantee that our Services will work with all devices. It is your responsibility to verify device compatibility before purchasing an eSIM plan.

6. Purchases and Payments

6.1 Payment Methods

We accept payments through:

Credit and debit cards (Visa, Mastercard, American Express, Discover, JCB, Diners Club, UnionPay)
Apple Pay
Google Pay
Other payment methods as may be available from time to time

All payments are processed securely through Stripe, our third-party payment processor.

6.2 Pricing

All prices are displayed in USD unless otherwise stated
Prices include applicable taxes where required by law
We reserve the right to modify prices at any time, but price changes will not affect orders already placed
Promotional pricing and discounts are subject to the terms and conditions of the specific promotion

6.3 Payment Processing

By making a purchase, you authorize us to charge your selected payment method
Payment must be completed before eSIM activation
Orders remain pending until payment is successfully processed
We reserve the right to refuse or cancel any order at our discretion

6.4 Currency and Exchange Rates

All transactions are processed in USD. If you use a payment method in a different currency, your bank or payment provider may apply exchange rates and fees, for which we are not responsible.

7. Refunds and Cancellations

7.1 General Refund Policy

All purchases are final. Refunds are only issued in the following circumstances:

Defective eSIM: If the eSIM is defective or unusable due to our error and cannot be replaced
Non-Activation: If the eSIM cannot be activated due to a technical issue on our end and the issue cannot be resolved within 48 hours
Duplicate Orders: If you accidentally purchase the same eSIM plan twice (subject to verification)
Service Unavailability: If we are unable to provide the purchased service due to circumstances beyond your control

7.2 Non-Refundable Situations

Refunds will NOT be issued for:

Device incompatibility
User error in installation or activation
Network outages or service interruptions in destination countries
Changes in travel plans
Failure to use the eSIM within the validity period
Data usage exceeding the plan limits
Misuse or violation of these Terms
Chargebacks initiated without first contacting our support team

7.3 Refund Process

To request a refund, contact us at hello@bayanat.app with your order number, reason for refund request, and supporting documentation (if applicable). Refund requests will be reviewed within 5–7 business days. Approved refunds will be processed to the original payment method within 10–14 business days.

7.4 Chargebacks

Unauthorized chargebacks may result in immediate termination of your account and all associated services. If you have a dispute, please contact our support team before initiating a chargeback.

8. eSIM Activation and Usage

8.1 Activation

eSIMs are activated upon successful payment and order completion
You will receive activation instructions via email and through the App
Activation must be completed within the timeframe specified for your plan
We are not responsible for delays in activation due to device incompatibility or user error

8.2 Installation Instructions

iOS devices: follow the installation guide provided in the App or via email
Android devices: follow the installation guide provided in the App or via email
QR codes and activation codes are provided for installation
You are responsible for correctly installing the eSIM on your device

8.3 Usage Limits

Data plans are subject to the data amount and validity period specified at purchase
Once data is exhausted or the validity period expires, the eSIM will no longer provide data service
Unlimited data plans are subject to fair use policies and may be throttled after certain usage thresholds
Top-up services may be available for some plans, subject to provider availability

8.4 Network Coverage

Network coverage depends on the service provider and destination country
Coverage maps and network information are provided for reference only
We do not guarantee network availability or quality in any specific location
Service interruptions may occur due to network maintenance, outages, or other factors beyond our control

9. Service Providers

We act as a reseller and are not responsible for:

The quality or availability of third-party provider networks
Service interruptions or outages on provider networks
Provider-specific terms and conditions
Changes in provider policies or services

10. Prohibited Uses

You agree NOT to:

Use the Services for any illegal purpose or in violation of any laws
Resell, redistribute, or transfer eSIM plans without authorization
Attempt to reverse engineer, decompile, or disassemble our Services
Interfere with or disrupt the Services or servers connected to the Services
Use automated systems to access the Services without permission
Share your account credentials with others
Use the Services to transmit harmful, offensive, or illegal content
Violate any intellectual property rights
Attempt to gain unauthorized access to our systems or other users' accounts

11. Intellectual Property

All content, features, and functionality of the Services — including text, graphics, logos, icons, images, software, code, applications, trademarks, service marks, trade names, design elements and user interfaces — are owned by Wavai Technology LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

12. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

13. Limitation of Liability

To the maximum extent permitted by law, Wavai Technology LLC and its affiliates, officers, directors, employees, agents, and service providers shall not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits or data, device damage, network outages, misuse of the eSIM, delays in activation, or any damages exceeding the amount you paid for the specific service giving rise to the claim.

14. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability or uninterrupted operation.

15. Indemnification

You agree to indemnify, defend, and hold harmless Wavai Technology LLC, its affiliates, officers, directors, employees, agents and service providers from and against any claims, damages, obligations, losses, liabilities, costs or expenses (including attorney's fees) arising from your use of the Services, your violation of these Terms, your violation of any third-party rights, or any content you submit through the Services.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Website, sending an email to the address associated with your account, or displaying a notice in the App. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

17. Termination

17.1 Termination by You

You may stop using the Services at any time by deleting the App from your device, closing your account or discontinuing use of the Website.

17.2 Termination by Us

We may suspend or terminate your access to the Services immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason we deem necessary.

17.3 Effect of Termination

Upon termination your right to use the Services will immediately cease, we may delete your account and associated data, and you will not be entitled to any refunds (except as provided in Section 7).

18. Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

18.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States.

18.3 Informal Resolution

Before filing a claim, you agree to contact us at hello@bayanat.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

19. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, government actions, network failures, provider service interruptions, or pandemics.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wavai Technology LLC regarding the use of the Services and supersede all prior agreements and understandings.
